USFWS Proposes Monarch Butterfly as Threatened Species
Proposed Threatened Listing for the Monarch Butterfly
Today, the U.S. Fish and Wildlife Service (USFWS) announced its proposed listing of the monarch butterfly (Danaus plexippus plexippus) as a threatened species under the Endangered Species Act (ESA). This proposal includes species-specific protections and flexibilities designed to encourage conservation efforts. Additionally, the USFWS plans to designate critical habitat in California’s overwintering grounds.
Understanding the Monarch Butterfly’s Decline
The monarch butterfly, renowned for its extensive migration across North America, has experienced significant population declines in recent decades. Factors contributing to this decline include habitat loss, climate change, and pesticide exposure. The proposed listing aims to prevent further decline and promote recovery by implementing tailored protections.
How the 4(d) Rule Supports Monarch Butterfly Conservation
Under the ESA, a “threatened” designation allows for customized protections through a 4(d) rule. The USFWS’s proposed 4(d) rule for the monarch butterfly seeks to incentivize proactive conservation efforts and permit activities that have beneficial or minimal impacts on the species, provided they do not threaten the overall population. This approach balances species protection with ongoing land management and conservation practices.
The proposal also includes designating 4,395 acres in seven coastal California counties as critical habitat. This designation focuses on areas essential for the monarch’s overwintering, aiming to safeguard and restore these vital habitats.
The USFWS is conducting a 90-day public comment period, open through March 2025, to gather input and any new information regarding the proposed listing and critical habitat designation. Following this period, the USFWS will review the comments and issue a final rule. If the monarch butterfly is listed, protections would be implemented after the final rule’s publication.
What This Means for Conservation and Compliance
This proposed listing has significant implications for landowners, businesses, and conservationists. While it introduces protections for the monarch butterfly, it also creates opportunities for proactive habitat restoration and management.
